These Terms of Service ("Terms") govern your access to and use of the website, Shopify applications, and services provided by BeyondTechnolabs ("BeyondTechnolabs," "we," "us," or "our") located at https://beyondtechnolabs.com. By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By installing our Shopify apps, visiting our website, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Services.

2. Description of Services

BeyondTechnolabs provides Shopify applications, custom e-commerce development services, and related software solutions. Our Shopify apps are available through the Shopify App Store or as private installations. Specific features and functionality vary by application and are described in each app's listing and documentation.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using our Services on behalf of a business, you represent that you have authority to bind that business to these Terms. Our Shopify apps require an active Shopify store and compliance with Shopify's Terms of Service.

4. Account and Access

Access to our Shopify apps is granted through Shopify's OAuth authentication system. You are responsible for maintaining the security of your Shopify account and for all activities that occur under your account. Notify us immediately at support@beyondtechnolabs.com if you suspect unauthorized access.

5. Subscription and Billing

Paid Shopify apps are billed through Shopify's Billing API. Subscription fees, billing cycles, and free trial terms are specified in each app's listing on the Shopify App Store. By subscribing to a paid plan, you authorize Shopify to charge your account according to the selected billing cycle.

  • All fees are exclusive of applicable taxes unless stated otherwise
  • Subscriptions renew automatically unless cancelled before the renewal date
  • Refunds are handled in accordance with Shopify's refund policies and applicable law
  • We reserve the right to change pricing with 30 days' notice to active subscribers

6. Acceptable Use

You agree not to:

  • Use our Services for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble our software
  • Interfere with or disrupt the integrity or performance of our Services
  • Use our Services to transmit malware, spam, or harmful content
  • Resell, sublicense, or redistribute our apps without written permission
  • Use automated systems to access our Services in a manner that exceeds reasonable use

7. Intellectual Property

All content, software, trademarks, and materials provided through our Services are owned by BeyondTechnolabs or our licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use our Shopify apps for their intended purpose while your subscription is active.

You retain ownership of your store data and content. By using our apps, you grant us a limited license to access and process your store data solely to provide the Services, as described in our Privacy Policy.

8. Custom Development Services

For custom development projects, specific terms including scope, deliverables, timelines, and payment schedules will be outlined in a separate project agreement or statement of work. In the absence of such agreement, these Terms apply to all custom development engagements.

9. Service Availability

We strive to maintain high availability for our Services but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by Shopify platform outages, third-party service failures, or force majeure events.

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEYONDTECHNOLABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless BeyondTechnolabs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our Services, violation of these Terms, or infringement of any third-party rights.

13. Termination

You may terminate your use of our Services at any time by uninstalling our Shopify apps or ceasing use of our website. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Services ceases immediately, and we will delete your data in accordance with our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if unresolved, submitted to the competent courts in India.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be posted on this page with an updated date. Continued use of our Services after changes constitutes acceptance of the revised Terms. For Shopify app subscribers, material changes may require re-acceptance.
